Your privacy is of great importance to the Neurodiversity Expertise Centre. When processing your personal data, we comply with the requirements set by current laws and regulations. This means that we process the personal data collected from you solely for the purpose of providing care to you and make every effort to protect the personal data collected.
We store your personal and health data in our electronic client file in the interests of the intake, examination, treatment, and the counselling thereafter. Only employees involved in providing care to you have access to this information and are authorised as well as bound confidentiality within the parameters that will be discussed during the intake.
Expertise Centre Neurodiversity considers it important to continuously improve the quality of care. We therefore use your dossier to continue our learning. The data is used under the condition of confidentiality for quality purposes for peer review, intervision and supervision, calamity, and incident investigation and/or for (external) audits.
Expertise centre neurodiversity retains only that information which is relevant, and which we are legally obliged to do. We are obliged to keep your file for 20 years. If you wish to have your file destroyed earlier, you can submit a request to this effect. See further 'accessing, changing and deleting your data'.
Expertise Centre Neurodiversity does not use automated decision-making that may affect individuals. To clarify automated decision-making means that a computer programme or system takes decisions.
Inspection, amendment, and deletion of your data
You have the right to inspect, correct or delete your personal data. You can also object to the processing of all or part of your personal data. You also have the right to have us transfer the data you have provided us with either to yourself or directly to another party on your behalf.
It is important that you can identify yourself and prove that the data you wish to access, correct, or delete belongs to you. You are not allowed to view data belonging to other individuals.
If you ask for an overview of your personal data (or a copy of a medical file), your copy will be sent by secure e-mail, or you can collect a paper copy. In principle, there is no charge for this transcript. However, there are limits to this: Providing it free of charge applies to one time access only. If you make a copy request on a regular basis, we may charge a reasonable fee. If a request is unfounded or excessive, the request may be refused, or a reasonable fee may be charged. A reasonable fee is, for example, the postage costs (for thick parcels) or a fee per copied page.
The right to correction is only for the adjustment of information, such as errors in a name or date of birth. If you disagree with impressions, opinions, or conclusions of us, such as diagnosis, then these will not be corrected. In this case, however, you do have the right to have your written comments added to the record. This right to addition is discussed under the Medical Treatment Agreement Act (WGBO).
Even if you have provided us with consent to process your personal data, you always have the right to revoke this permission.
With questions about exercising your rights to access, change and delete your data, it is best to contact your coach/practitioner/case manager/personal supervisor.
Security
Security of personal data is of great importance to us. Expertise Centre Neurodiversity takes appropriate measures to prevent abuse, loss, unauthorised access, and other undesired actions with personal data. We will also require this from parties processing personal data on our behalf.
Filing a complaint
Should you have a complaint about the processing of your personal data, we ask you to contact us directly about this. To do so, you can contact our complaints officer via NvGZP/NIP.
If you suspect a data breach, we ask you to contact our Data Protection Officer directly via 06-22443657. A data leak may occur if personal data falls into the hands of third parties who should not have access to that data. A data leak could also include a lost paper file or USB stick, break-in by a hacker or an e-mail containing confidential information to an unauthorised third party.
Complaint?
Of course, it may happen that you are not satisfied with the support provided or you have a complaint. We would be pleased if you would discuss this firstly with us; so that we can see if we find a suitable solution together.
However, should this not suffice, you do have the option of a formal procedure. If you feel that your coach/psychologist/therapist is seriously deficient in her professional conduct, you can also file a complaint with the Central Disciplinary Tribunal for Health Care (070 381 37 00) under the BIG Act.
For assistance in filing your complaint, you can contact the Healthcare Information and Complaints Office (IKG) in your region. The IKG can assist you during the disciplinary procedure. Telephone: 0900 2437070 and you will be connected to the IKG office in your region.
You can find more information on the website of Disciplinary Boards for Health Care. It can be found on the website of the Dutch Association for Psychotherapy (NVP). The professional code regulates privacy and states that information may only be passed on to third parties with the client's written consent.
I also make use of the complaints procedure through the Netherlands Institute of Psychologists (NIP), Complaints procedure for providers under the Wkkgz - NIP (psynip.nl)
In case of an emergency
Expertise Centre Neurodiversity does not have a 24-hour on-call service. In case of an emergency, you can contact your GP and, outside office hours, the GP out-of-hours service. If necessary, the GP can refer you to the GGZ crisis service.
